- Two laws govern ending a job. The 1998 Labour Code and the 2017 hiring and termination law both apply, and a dismissal needs a legitimate reason that is given to the employee in writing.
- The minimum wage has been XOF 52,000 a month since 1 January 2023. A decree sets it, and no pay can fall below it.
- Employer costs come on top of gross pay. On our arithmetic they add about 20.4% to 23.4%: pension, family benefits, work-injury cover and a 4% payroll levy.
Hiring in Benin adds employer social security of 6.4% for pensions, 9% for family benefits and 1% to 4% for work injury, plus a 4% employer payroll levy. The employee pays 3.6% towards the pension.
Employment income is taxed under the ITS table, which is nil up to XOF 60,000 a month and tops out at 30%. The legal week is 40 hours, and leave accrues at two working days a month.
Teamed runs payroll, contracts and compliance for your Benin hire. This page is the map. Each guide below is the detail.
How does Teamed handle Benin hiring for you?
Teamed employs your Benin hire and runs payroll, contracts and compliance from $599 per employee per month, with zero FX markup in any currency.
Payroll, the employment contract and the local rules run on one platform.
Real HR and legal experts manage every Benin hire, and a designated person runs your first hire from signed terms to first payslip. There is no setup fee and no exit fee. Employer costs pass through at cost, itemised on every invoice.
Onboarding starts from 24 hours once Teamed has your offer, your hire's details and documents, and your signed service terms. Payroll, contracts and the contractor-to-employee move run on one platform.
A Benin contractor who becomes an employee keeps their record, and the same employee can graduate to your own Benin entity later. Run the Crossover Calculator to see the month the model flips. EOR is the right model for a first Benin hire, until it isn't.
How much does it cost to hire an employee in Benin in 2026?
A Benin hire costs gross pay plus about 20.4% to 23.4% in employer social security and payroll levy, on our arithmetic.
On a gross pay of XOF 300,000 a month, that is XOF 61,200 to 70,200 a month on top of pay.
The range comes from the work-injury rate, which runs from 1% to 4% by risk. The pension rate is 6.4% and the family rate is 9%, both paid by the employer, and the employer's tax on wages is 4%.
Teamed's Benin fee is a starting rate, with zero FX markup in any currency. Gross pay, taxes and benefits pass through at cost, itemised on every invoice.
The cost guide has the worked table at four pay levels.
Do you need a Beninese company to hire employees in Benin?
No. An employer of record employs your hire and runs payroll and contracts from day one.
Your own entity can cost less as you grow, but the crossover moves with your fee, your entity quote and your growth, so run the Crossover Calculator for your own number.
Hiring directly means taking on the employer's duties yourself: registering with the CNSS, withholding tax on wages and following the Labour Code on hours, leave and dismissal. An employer of record carries those from the first day.
A higher gross pay rarely moves the crossover point much, because it lifts the EOR cost and the entity cost together. The EOR vs entity guide shows what changes in Benin.
You progress from contractor to EOR to your own Benin entity on one platform under Teamed's Graduation Model.
Which Benin employment laws apply to a new hire?
The Labour Code, Loi n° 98-004 of 27 January 1998, is the base text. The 2017 law, Loi n° 2017-05, changed hiring and termination rules.
The minimum wage has been XOF 52,000 a month since 1 January 2023.
The 2017 law came later and, among other changes, lets a fixed-term contract be renewed without a set limit. The 1998 Code caps it at two years, renewable once. The two texts are not easy to reconcile on that point, so we show both in the hiring guide.
Tax comes from the General Tax Code, and social security from the Social Security Code, Loi n° 98-019.
What leave and benefits must you give Beninese employees?
Paid annual leave accrues at two working days for each month of service, and the right to take it opens after a year.
Maternity leave is 14 weeks on full pay, paid under the CNSS arrangements.
An employee who is ill keeps pay for a period that depends on service: up to three months of full pay and three of half pay after a year, and six months of full pay after five years. A mother has nursing breaks of up to one hour a day for 15 months after she returns.
The public holiday list sits in a separate law, so we don't print one. The hiring guide sets out each rule.
What are payroll taxes in Benin in 2026?
Tax on wages and salaries (ITS) is withheld monthly under a five-band table that is nil up to XOF 60,000 and tops out at 30%.
ITS and the employer's 4% payroll levy are due by the 10th of the following month.
The employer also pays social security to the CNSS. Employers who use the tax authority's online services file one declaration for tax and social security.
The tax and payroll guide has the full table and worked examples.
How do you terminate an employee in Benin?
A dismissal needs a legitimate reason, a written notice that states it, and a chance for the employee to answer beforehand.
Notice is 15 days, one month or three months, depending on the employee's category.
A dismissal that a court finds abusive can mean compensation of three to nine months of gross pay. An economic dismissal adds a notification to the labour inspector and a waiting period of 21 days or more.
The termination guide covers notice, the procedure, protected employees and what the law does not say about severance.
What should you know before hiring in Benin?
Two things catch employers out. Benin has two overlapping employment statutes, and the rules for a dismissal are strict.
Both change how you draft the contract and how you plan an exit.
Two statutes, one contract. A few points, such as fixed-term renewals, are treated differently in the 1998 Code and the 2017 law. Draft the contract with both in view and keep probation within the Code's limits.
A dismissal is a procedure, not a notice letter. The employer needs a legitimate reason, a written notice and a hearing, and tells the labour inspector. Skipping a step can turn a lawful reason into a costly dismissal.

What is the minimum wage in Benin in 2026?
XOF 52,000 a month under Décret n° 2022-692, applying from 1 January 2023. It replaced a minimum of XOF 40,000, a 30% rise. The Labour Code says no pay can be lower than the minimum wage.
What is employer social security in Benin?
6.4% for pensions, 9% for family benefits (including 0.2% for maternity cash benefits) and 1% to 4% for work injury, depending on risk. The employee pays 3.6% towards the pension. Separately, the employer pays a 4% tax on wages.

Two working days for each month of service, which is 24 a year, and the right to take it opens after one year of service. Public holidays are set by a separate law, which we confirm before the first payslip.
How much notice does an employer give in Benin?
15 days for hourly-paid workers, one month for employees and workers paid by the month, and three months for supervisors and managers. The same notice applies to an employee who resigns.
Benin sets the minimum wage at XOF 52,000, adds about 20% to 23% in employer costs, and expects a dismissal to follow a procedure.
Most of the surprises come from the two overlapping employment statutes, or from skipping a step before an exit.
Read the guide for the layer you are on before the first offer goes out, not after the first payslip.
