The short answer

Notice is 15 days for hourly-paid workers, one month for employees and workers paid by the month, and three months for supervisors and managers. The same notice applies when the employee resigns.

An abusive dismissal carries compensation of three to nine months of average gross pay. We found no statutory severance formula, so the figure that applies comes from the contract, the collective agreement or custom.

When can you dismiss an employee in Benin?

A dismissal needs a legitimate reason. The Code asks for an objective and serious reason, which can concern the person or can be economic.

In a dispute, the employer must prove that the reason existed.

A personal reason can be ill health, inability to do the job, poor performance or misconduct. An economic reason is the loss or substantial change of a post because of technology, reorganisation, economic difficulty or closure.

Serious misconduct can justify ending the contract without notice, subject to a court's view of its gravity. The Code lists examples, such as embezzlement, drunkenness, violence at work and repeated late pay.

What steps must a dismissal follow in Benin?

The employer notifies the dismissal in writing with the reason, after the employee has had the chance to answer on the reason.

Skipping a step can lead to an indemnity of up to two months of gross pay.

  1. Hear the employee

Let the employee say what they think about the reason before any decision. This does not apply to a collective economic dismissal.

  2. Write the letter

State the reason, the employer's name, its CNSS number and address, and the employee's details and CNSS number.

  3. Tell the labour inspector

Send the inspector the same information at the same time.

  4. Run the notice

The notice starts the day after the dismissal is notified.

The 2017 law says a dismissal for a legitimate reason that lacks the written notice, the stated reason or the hearing is not abusive for that alone. The court can award an indemnity of up to two months of gross pay, and only from one year of service.

How much notice must you give in Benin?

Notice in a permanent contract is 15 days for hourly-paid workers, one month for employees and workers, and three months for supervisors and managers.

An employee who resigns gives the same notice, and the employer may release them from working it without paying extra.

CategoryNotice
Hourly-paid workers15 days
Employees, workers, labourers1 month
Supervisors, managers and similar3 months

During notice the employee gets two days off a week to look for work, on full pay. A dismissed employee who finds a new job can leave early without paying for the unworked notice.

A party that ends the contract without notice owes the other the pay and benefits for the notice period. Serious misconduct is the exception, subject to the court's view of its gravity.

What extra steps apply to an economic dismissal in Benin?

The employer tells the labour inspector first, with the reasons, the number of employees and the period. Then it waits at least 21 days before it notifies a dismissal.

The wait is 30 days when more than 11 employees are affected and 45 days when more than 50 are.

Where the company has staff delegates, they get the same information and meet the employer at least once during the wait. A dismissed employee keeps a priority for re-hire in the same category for two years, and the employer must tell them of a vacancy by registered letter.

An economic dismissal without the information to the inspector carries a fine of XOF 14,000 to 84,000 for each employee, under the Code. The 2017 law sets a fine of XOF 10,000 to 100,000 for breaking the economic dismissal rules, doubled for a repeat. A negotiated departure agreement does not need the economic procedure, but the inspector gets a copy.

What compensation is payable when you end a contract in Benin?

The law sets damages for an abusive dismissal at three to nine months of average gross pay over the last 12 months.

We found no statutory severance formula in the Labour Code or the 2017 law.

SituationWhat the law says
Abusive dismissal (2017 law)3 to 9 months of average gross pay over the last 12 months
Legitimate reason, but a procedure step missedUp to 2 months of gross pay, from 1 year of service
Early end of a fixed-term contractUp to the pay for the rest of the term, at most 9 months
Dismissal of a pregnant employee, in breachAt least 12 months of pay
Notice not givenPay and benefits for the notice period

The Code also says damages for a dismissal without a legitimate reason are not below six months of pay for an employee with five years of service. The 2017 law came later, and the two are not easy to reconcile, so a Benin lawyer's view is worth having before a dismissal.

The Code refers to a dismissal indemnity that a contract, a collective agreement or custom may set. A fixed-term contract that the employer does not renew after the fourth term carries an end-of-collaboration indemnity on the same conditions. Teamed confirms what applies to the role before any exit.

Which employees have extra protection in Benin?

A pregnant employee cannot be dismissed, except for serious misconduct unrelated to the pregnancy or when keeping the contract is impossible.

A dismissal in breach carries damages of at least 12 months of pay.

The protection covers the leave itself: nobody can be dismissed during maternity leave, and the leave suspends any notice already running. If the employer did not know about the pregnancy, the employee has 15 days to prove it and the dismissal is cancelled.

When the employment ends, the employer gives a work certificate with the entry and exit dates and the jobs held. A receipt for all accounts that the employee signs does not stop them from claiming what is owed.

What happens if a Benin dismissal is challenged?

The employee goes first to conciliation before the labour inspectorate, and then to the labour court.

Claims for wages and leave lapse after three years, and claims for dismissal indemnities and reparation after ten.

A conciliation record that sets out an agreement bars a later claim for reparation on the same dispute. Plan the process, the reasons and the record before you end a contract.
