The short answer

Benin caps the legal working week at 40 hours and the normal day at 8. An employer can impose up to 240 overtime hours a year, and the effective week can never pass 60 hours or 12 hours a day.

Paid leave accrues at two working days a month. Maternity leave is 14 weeks on full pay, and the minimum wage is XOF 52,000 a month.

What must a Benin employment contract say?

A permanent contract can be written, verbal or implied, but it must be written when the worker has to move away from home. A fixed-term contract must be in writing.

The 2017 law says that without a written contract, the employment can be proved by any means.

RuleWhat the law says
Fixed-term contract, 1998 CodeAt most 2 years, renewable once. Written if longer than 1 month, and the labour office visa is deemed granted after 30 days
Fixed-term contract, 2017 lawWritten, and can be renewed without a set limit. From the fourth term, non-renewal needs notice
Change to the contractProposed in writing, with 8 days for the other side to think
Notify the labour ministryThe employer tells it which posts were filled, and registers and affiliates the worker for social protection

The 2017 law came later, and the two texts are not easy to reconcile on fixed-term renewals. A cautious employer keeps a fixed-term contract within the Code's two years and one renewal, and states the reason in writing.

Seasonal, temporary and occasional workers have fixed-term contracts of six months at most under the Code, and after more than six months of continuous work they can become permanent.

How does probation work in Benin?

Probation must be in writing. In a permanent contract the Code sets a maximum of 15 days, one month or three months, depending on the category.

It can be renewed once, in writing, and either side can end it without notice.

CategoryLongest probation, permanent contract
Hourly-paid employees, workers, labourers15 days
Monthly-paid employees, workers, labourers1 month
Supervisors, managers and similar3 months

In a fixed-term contract, probation is one day per week of expected work, up to one month for employees and workers and three months for supervisors and managers. The employee is paid during probation at the rate of the category.

The 2017 law leaves the length to the time needed to test the worker, with no number. We show the Code's limits because they are the only figures in the statutes.

What are the working-hours rules in Benin?

The legal working week is 40 hours outside agriculture, and the normal day is at most 8 hours unless a decree or collective agreement says otherwise.

An employer can impose up to 240 overtime hours a year, and the effective week can never pass 60 hours or 12 hours a day.

OvertimeLowest premium on the hourly rate
Day, 41st to 48th hour12%
Day, beyond the 48th hour35%
Day, Sundays and public holidays50%
Night, weekdays (21:00 to 05:00)50%
Night, Sundays and public holidays100%

A collective agreement fixes the actual rates, and they cannot fall below these percentages. Beyond 240 hours a year, overtime needs the labour inspector's prior authorisation. In agriculture the legal time is 2,400 hours a year.

Weekly rest is at least 24 consecutive hours, in principle on Sunday. Benin sets no statutory hourly minimum wage, only the monthly one.

How much leave do Beninese employees get?

Paid annual leave accrues at two working days for each month of service, and the right to take it opens after one year.

The leave must be taken within twelve months, and the employee is told the dates at least 15 days ahead.

Leave and payEntitlement
Annual leave2 working days for each month of service, so 24 a year
Extra leave for long service2 days after 20 years, 4 after 25 and 6 after 30, with a total of at most 30 working days
Workers under 18, on request30 working days
Workers aged 18 to 21, on request24 working days
Leave allowanceAt least one twelfth of pay over the previous 12 months
Claim for unused leaveLapses after 3 years
Public holidaysSet by a separate law

Working days are every day except the weekly rest day and public holidays. An employee who is ill keeps pay for a period that depends on service, set out in the cost guide.

We don't print a public holiday list, because the Code leaves it to a separate law. Teamed confirms the list before the first payslip.

What maternity leave must you give in Benin?

Maternity leave begins six weeks before the expected birth and ends eight weeks after it, which is 14 weeks in all, on full pay.

It can be extended by four weeks when a doctor certifies illness caused by the pregnancy or the birth.

When the birth is early, the leave runs on until the employee has had 14 weeks, and when it is late, she returns no sooner than eight weeks after the birth. The pay is paid under the CNSS's arrangements, and she keeps free care and benefits in kind.

For 15 months after she returns to work, a mother has nursing breaks of up to one hour a day. A dismissal that breaks the pregnancy protection carries damages of at least 12 months of pay. We found no statutory paternity leave in the Code, so the hiring guide prints none.

What changes when you hire a foreigner in Benin?

The Code says a foreign worker needs a work permit from the labour ministry, issued for 12 months and renewable.

During the first two years of regular residence, the Code limits a foreigner to a fixed-term contract.

The 2017 law says the permitted contract can be fixed-term or permanent, and leaves the formalities to a decree taken in the Council of Ministers. We did not read that decree, so we confirm the permit steps and the contract type for your hire before an offer goes out.

How must you pay Beninese employees?

Pay is in legal currency, at intervals of at most one month for monthly-paid employees and 15 days for hourly-paid ones.

Monthly pay is due within eight days after the month ends, and the employee gets a payslip each time.

An employee paid by the month can ask for an advance after 15 days, up to half of monthly base pay. Pay in alcohol, drugs or goods is forbidden, and no pay can fall below the XOF 52,000 minimum wage.

On a breach of the minimum wage, housing or pay-date rules, the Code sets a fine of XOF 14,000 to 70,000 for each breach. When a contract ends, pay and indemnities are due from the end of service.

A note from Tom Price-Daniel

Benin gives you a 40-hour week, two days of paid leave a month and 14 weeks of maternity leave on full pay.
The traps sit in the details: two statutes that differ on fixed-term renewals, and a probation that must be written.
Your designated person runs the first hire from signed terms to first payslip.
