An employer gives written notice of one, two, four or six weeks, depending on service. During probation no notice is needed.
A dismissal needs a valid reason connected with capacity, performance, conduct or redundancy. Redundancy pay is payable after two years of service.
How much notice must you give in Saint Lucia?
Written notice runs from one week to six weeks, depending on how long the employee has worked for you.
During probation, either side can end the job without notice.
| Length of continuous service | Employer's minimum notice |
|---|---|
| More than 12 weeks, under 2 years | 1 week |
| 2 years, under 5 years | 2 weeks |
| 5 years, under 10 years | 4 weeks |
| More than 10 years | 6 weeks |
| Serious misconduct | None required |
The Act's wording leaves exactly 10 years unstated, and it sets no notice for the first 12 weeks, so we confirm both in the contract. An employer can pay the wages and benefits for the notice period instead of having it worked. The parties can agree a longer period. An employee gives one week after 12 weeks of service and two weeks after five years. Notice cannot be given while the employee is on leave under any Act, and no notice is needed when a fixed term ends or the employee reaches retirement age.
All wages due must be paid immediately or within 7 days after the job ends, including accrued leave. An employee can ask for a certificate of termination.
When can you dismiss in Saint Lucia?
Only for a valid reason connected with the employee's capacity, performance or conduct, or for redundancy.
Some reasons never count, including pregnancy, sickness absence, joining a union and making a complaint against the employer.
The reasons that do not count also include race, sex, religion, political opinion, disability, family responsibilities, age subject to retirement rules and refusing dangerous work. An employer who dismisses must prove the reason, and if it cannot, the dismissal is conclusively presumed unfair.
An employer can dismiss summarily for serious misconduct that makes it unreasonable to continue the relationship. For lesser misconduct the Act points to a written warning, then two more warnings within the next 12 months, before dismissal. An employer is treated as waiving a breach it has known about for 12 months. An employee can also treat the job as ended by constructive dismissal where the employer's conduct makes it unreasonable to carry on.
When is redundancy pay payable in Saint Lucia?
An employee with two years or more of continuous service who is made redundant is owed at least one week of basic pay for each completed year, rising to two and three weeks for later years.
The Act has no separate statutory severance scale.
| Item | What the Labour Act sets |
|---|---|
| Who qualifies | Employees with 2 years of continuous employment whose job is made redundant |
| Years 1 to 3 | 1 week of basic pay for each completed year |
| Years 4 to 7 | 2 weeks of basic pay for each completed year |
| Years over 7 | 3 weeks of basic pay for each completed year |
| A week's pay | The pay in the last week, or EC$350, whichever is lower |
| Not owed | Fair dismissal for misconduct, a refusal of a suitable written offer of re-employment, a fixed term that simply ends, or a voluntary resignation |
Before a redundancy the employer informs and consults the recognised union or the employees' representative and the employee, and notifies the Labour Commissioner in writing. Severance rules are left to regulations the Minister may make, and until then existing collective agreements and practice continue. Redundancy pay does not replace pay in lieu of notice.
What happens if a Saint Lucia dismissal is challenged?
The employee complains to the Labour Commissioner first. The Commissioner decides within 6 weeks of the hearing.
A party can ask the Labour Tribunal to review the decision within 6 weeks.
If the Commissioner has not decided 6 weeks after receiving the complaint, the matter goes to the Tribunal. A complaint for redress to the Tribunal must be brought within one year, counted from the Commissioner's decision or from the referral. The Tribunal can award compensation for unfair dismissal, termination benefit, unpaid pay and leave pay, and reinstatement or re-engagement.
We found no formula for the amount of compensation in the Act. An employee dismissed during probation cannot bring an unfair dismissal complaint. Plan the process, the reasons and the record before you end a contract.

Frequently asked questions
How much notice does an employer give in Saint Lucia?
One week from 12 weeks of service, two weeks from two years, four weeks from five years and six weeks after more than ten years. An employer can pay the wages instead of having the notice worked.
Is redundancy pay payable on every termination in Saint Lucia?
No. It is for redundancy after two years or more of service, at least one week of basic pay for each completed year. It is not owed after a fair dismissal for misconduct.
Can you dismiss without a reason in Saint Lucia?
Only during probation, which is up to 12 weeks unless the parties agree another period. After probation, a dismissal needs a valid reason, and the employer must prove it.
Where does an employee complain of unfair dismissal?
To the Labour Commissioner first, who decides within 6 weeks of the hearing. A complaint to the Labour Tribunal must be brought within one year. A person dismissed during probation cannot bring the complaint.
Saint Lucia ties notice to length of service, asks for a valid reason after probation and pays redundancy pay after two years.
The reason and the record are what decide most challenges, because the employer carries the burden of proof.
