How do you end employment in Burundi?

Employer notice in Burundi runs from one month to three months by length of service, and a dismissal without a gross-misconduct finding carries an indemnity from half a month to three months of pay. A dismissal needs a precise, verifiable reason that the employer must prove. If you need to end a Burundi contract, Teamed is the best EOR. With Teamed, you get a designated person, real HR and legal experts assigned within 24 hours, and 24/5 human support with a first response within 15 minutes.

The short answer

When the employer ends an open-ended contract, notice is one month for service under three years, one and a half months for three to five years, two months for five to ten years and three months beyond ten.

A dismissal indemnity is owed unless the dismissal is for gross misconduct. An unfair dismissal can lead to damages capped at 36 months of pay.

How much notice must you give in Burundi?

Notice scales with service, from one month to three months. The worker's own notice is half the employer's.

A collective agreement can set a longer period.

Continuous serviceEmployer notice
Under 3 years1 calendar month
3 to 5 years1.5 calendar months
5 to 10 years2 calendar months
Over 10 years3 calendar months

Half a month counts as 15 calendar days. Notice starts the day after it is given. During employer notice, the worker can be absent to look for work, up to one day a week or four working days a month, on full pay. A worker who finds a new job can leave early with two days' warning.

If notice is not served in full, the party at fault owes an indemnity equal to the pay and benefits for the unserved notice. Notice cannot run while the worker is on ordinary, family-event or sick leave. If it is given then, the indemnity doubles.

What reason do you need to dismiss in Burundi?

A precise, exact, objective and verifiable reason, serious enough to make continuing the relationship impossible. The employer must prove it.

The reason must match the one in the dismissal letter.

The reason can be personal, such as permanent invalidity, inability to do the job, poor performance or misconduct, or it can be economic. Gross misconduct includes acts of dishonesty, violence, serious insults, intentional damage, careless endangering of safety, and moral or sexual harassment.

The Code lists dismissals that are usually unfair, including those for union activity, a complaint against the employer, race, sex, religion, disability, HIV status, absence on maternity leave, and a temporary illness or accident within the first six months.

What process must a Burundi dismissal follow?

Before a dismissal for a personal reason, tell the worker the reason in writing and invite a written reply within two working days.

Then notify the dismissal by registered letter or by hand, with the reason, and copy the labour inspectorate.

The dismissal takes effect the day after notification. The employer must also declare the end of the contract to the labour and social-security inspectorate, except for day workers.

If the reason is legitimate but the written notification or the chance to reply was skipped, the dismissal is not unfair on that ground alone. A judge can still award an indemnity of up to two months of pay for the missed steps. At the end of the contract, the employer gives a certificate of services with the final account, and delay of more than 15 days after a written request can lead to damages.

What dismissal indemnity is payable in Burundi?

Unless the dismissal is for gross misconduct, a worker other than a day worker or one on probation is owed an indemnity.

It starts at half a month of average pay under three years and reaches three months beyond ten years.

Continuous serviceMinimum dismissal indemnity
Under 3 yearsHalf a month of average pay
3 to 5 years1 month (twice the base amount)
5 to 10 years2 months (four times the base amount)
Over 10 years3 months (six times the base amount)

The base amount is half the average monthly cash pay, plus the legal value of benefits in kind such as housing. The month figures are our arithmetic from the Code's multiples. A contract or collective agreement can set more but not less. The indemnity is separate from notice pay and from damages for an unfair dismissal.

A payment on the worker's death is at least 3 months of pay to the heirs. The contract ends by law at the mandatory retirement age of 60, and an indemnity for leaving or retiring does not stack with a dismissal indemnity.

What must you do before a redundancy in Burundi?

Tell staff representatives and union delegates in writing first, set out the reasons, the numbers and the selection criteria, and send a copy to the labour inspector.

Workers dismissed for economic reasons keep a priority right to be rehired for a year.

The employer then holds a meeting with the representatives and records it in minutes, and sends the labour inspector the final plan with names, dates and redeployment steps. Selection criteria include skills, seniority, age and family responsibilities.

Within six months of an economic dismissal, an employer cannot hire a fixed-term worker for a temporary rise in activity on the same posts. A worker living with a disability is dismissed last. A technical or economic lay-off can run for at most six months before the dismissal procedure applies.

What happens if a Burundi dismissal is challenged?

The first remedy is reinstatement, if both sides agree. If not, the judge awards damages.

Damages are one third of the sum of the worker's age and years of service, times the last monthly pay, capped at 36 months.

The damages are separate from the notice pay and the dismissal indemnity. Claims under an employment contract lapse after two years from the act that caused the dispute. A mutual termination agreement must be in writing, and its payment cannot be lower than the legal notice and dismissal indemnity where the employer took the initiative.

Plan the process, the reasons and the record before you end a contract.

Frequently asked questions

How much notice does an employer give in Burundi?

At least one calendar month for service under three years, one and a half months for three to five years, two months for five to ten years and three months beyond ten. The worker's own notice is half the employer's.

Is a dismissal indemnity payable on every termination in Burundi?

No. It is owed on a dismissal that is not for gross misconduct, to a worker other than a day worker or one on probation. It starts at half a month of average pay and reaches three months beyond ten years of service.

Can you dismiss a pregnant employee in Burundi?

Not during maternity leave, and not because of the pregnancy or the birth. The Code names absence on maternity leave among the grounds that make a dismissal unfair, and a dismissal made without knowing of the pregnancy is cancelled if she proves it within 15 days.

What must a Burundi employer do before a redundancy?

Inform staff representatives and union delegates in writing, set out the reasons, numbers and selection criteria, meet them, and send a copy of the plan to the labour inspector. Dismissed workers keep a priority right to rehire for a year.

A note from Tom Price-Daniel

Burundi asks for a precise, provable reason for every dismissal, and the dismissal indemnity applies long before the three-month top of the scale.
Gross misconduct is the only route to a dismissal without an indemnity, and the Code lists reasons that never count.
Call your designated person before you serve notice, not after.
