The standard work day is 8 hours and the week 48. Hours beyond that earn premium pay of at least 1.5 times the basic hourly wage. The minimum wage is EC$11.50 an hour.
Employees earn one day of paid vacation for each month worked after probation. The Public Holidays Act sets 11 public holidays a year, and maternity leave is at least 14 weeks.
What must a written contract or statement cover in Antigua and Barbuda?
Within 10 days of the start, the employer must give the employee a written statement of working conditions.
It covers duties, hours and rest periods, starting pay and how it is worked out, the term, probation, and leave.
An individual contract is lawful, but any term below the Labour Code's minimums is void. Put the probation period, the pay and the contracted hours in writing, and give the employee a new written statement whenever the duties change.
A fixed-term contract cannot be used for a permanent position. A fixed-term worker is treated as a full-time employee after two or more renewals once the total period reaches a year. The rule does not apply to consultants, management or the professions the Labour Code lists, such as lawyers, doctors and accountants.
What are the working-hours rules in Antigua and Barbuda?
The standard work day is not more than 8 hours and the standard week not more than 48.
Hours beyond that earn premium pay of at least one and a half times the basic hourly wage.
| Rule | What the Labour Code sets |
|---|---|
| Standard day and week | 8 hours a day, 48 hours a week |
| Premium pay | At least 1.5 times basic hourly wage for hours beyond 8 in a day or 48 in a week |
| Absolute ceiling | 12 hours in any 24, and 72 hours in any 168, unless a Ministerial order allows more |
| Weekly rest | At least 24 consecutive hours in every seven days |
| Work on a public holiday | At least 150% of the basic hourly rate, on top of holiday pay |
The Minister can change these standards for an industry by order. A collective agreement can set different rules, so check whether one covers the role.
How does probation work in Antigua and Barbuda?
Probation cannot last more than three months unless a registered trade union's collective agreement allows longer.
During it, either side can end the job on 24 hours' notice, with no reason needed.
The employee must be given reasonable training in the duties of the job and be kept informed of progress. Leave entitlements and the right not to be unfairly dismissed start when probation ends. The employer cannot use probation to interfere with the employee's right to organise.
The termination guide has the rules after probation.
How much leave do employees get in Antigua and Barbuda?
Vacation is at least one day of paid leave for each month of employment, earned once probation has ended.
On top of that come 11 public holidays a year and sick pay for the first 12 days of illness in each twelve months.
| Leave | Entitlement |
|---|---|
| Vacation | At least 1 day per month of employment, on at least basic wage |
| Public holidays | 11 a year, set by the Public Holidays Act |
| Sick leave with pay | The first 12 days in each twelve months, at basic wage |
| Maternity leave | At least 14 weeks after 12 months' unbroken service |
| Paternity leave | None in the Labour Code |
The 11 public holidays are New Year's Day, Good Friday, Easter Monday, Labour Day, Whit Monday, the two Carnival days in August, Independence Day on 1 November, V.C. Bird Day on 9 December, Christmas Day and Boxing Day. The day after a general election is a further holiday when one is held. Sundays are not counted for holiday pay.
An employee who does not work a public holiday loses no pay, provided they worked the scheduled day before and the day after it. Vacation leave does not include public holidays or sick leave, and unused vacation is paid out when the job ends.
The employer can ask for a doctor's certificate or other satisfactory evidence from the third consecutive day of sick leave. Social Security sickness benefit is separate: it pays 60% of average insurable weekly earnings, from the fourth day of illness.
What maternity leave must you give in Antigua and Barbuda?
A female employee with twelve months of unbroken service is entitled to at least 14 weeks of maternity leave.
The employer pays at least 40% of basic wages during it, and the Social Security Board pays a maternity allowance.
The employee must produce a medical certificate stating the presumed date of confinement. The Social Security Board's maternity allowance is 60% of the insured person's average insurable weekly earnings, for up to 14 weeks. The Board's own web page still says 13 weeks, but a 2022 regulation changed it to 14.
The Labour Code gives no statutory paternity leave. Any paternity leave is a matter of contract or policy.
Does a hire need a work permit in Antigua and Barbuda?
A person who is not a citizen needs a work permit to be employed in Antigua and Barbuda.
A permit lasts up to one year and can be renewed.
The application fee is EC$100 after a 2020 amendment, and a separate permit fee is set by order. Some groups are exempt, so we check the route for each hire.
We check each hire's right to work before the contract is signed.
