What should be on an HR compliance checklist?

Rules differ by country, so each line asks you to check the country guide or your adviser. It does not state the rule. Give each country an owner, and tick a line when its "done when" test is true for that country.

Who employs whom

  • Legal employer, defined

  • Employee vs contractor checklist

  • Country hiring guides

Contracts and policies

  • Employment contract checklist and review template

  • Employee handbook, defined

Time and pay

  • Working time regulation

  • Payroll compliance checklist

People data

  • GDPR, defined

  • Cross-border data transfer

  • Documentation retention schedule

Safety and conduct

Change and exit

  • Works council

  • Employee termination checklist

Review

  • Global HR compliance audit

That is the whole checklist.

Why does multi-country HR compliance need a checklist?

A company with people in several countries answers to several sets of rules at once. A policy that works at head office may not fit another country's rules on contracts, hours or data.

The checklist keeps one owner and one test for each area, so that a gap shows up as an unticked line and not as a problem found later.

Questions people ask

  • What is HR compliance?

HR compliance means employing people in line with the laws and rules that apply where they work. It covers contracts, pay, working time, leave, people data, safety and how employment ends.

  • How often should we check HR compliance?

Review each country each quarter, and whenever you hire, change a contract or learn of a law change. Run a fuller audit once a year.

  • Who is responsible for HR compliance if we use an employer of record?

Read the service agreement to see what each side owns. In an employer of record arrangement the provider is the legal employer, and you still direct the work and supply the facts. Keep your own checks, such as working hours and conduct.

This checklist is a planning aid, not legal advice. Where a step depends on a country's rules, check the country guide or take advice.
