The employer gives the written terms within 14 days of the employee's request. They cover pay, hours, probation, notice and leave. Probation is up to three months, or four weeks for household employment.
Annual leave is at least 14 paid days, and maternity leave is 13 weeks. Overtime pays 1.5 times the normal rate, and 2 times on a rest day or public holiday.
What must a written contract or statement cover in Saint Kitts and Nevis?
The employer must give the terms and conditions in writing within 14 days of the employee's request.
The regulations list the content: names, start date, post and duties, pay and pay intervals, hours, overtime, probation, notice and leave.
Pay intervals in the written terms may not exceed one month. The employer must also instruct each employee in the work rules at the start, including the rules on safety, health and welfare.
Pay is in Eastern Caribbean currency, or in another legal tender only with the worker's written consent. The employer keeps a register of wage payments, and each worker may ask for a copy of their account. Rates of pay and conditions are shared before the worker starts and again at least two weeks before any change.
What are the working-hours rules in Saint Kitts and Nevis?
The Acts we read set no general weekly maximum. The wage orders set the overtime line instead.
Under the national minimum wage schedule, hours over 40 a week or 8 a day are overtime, paid at 1.5 times, and at double time on a rest day or public holiday.
| Rule | What the law sets |
|---|---|
| Overtime line, national schedule | Hours over 40 a week or over 8 a day |
| Overtime pay, ordinary day | 1.5 times the normal rate |
| Overtime pay, rest day or public holiday | 2 times the normal rate |
| Pay intervals, hourly, daily or weekly workers | At least once a week |
| Pay intervals, monthly or annual workers | At least once a month |
| Deductions for tools, advances and approved schemes | No more than one third of the wages for a pay period |
| Night work, women in industrial undertakings | Restricted, with exceptions for management roles and emergencies |
| Children | Under 16, may not work in an industrial undertaking, apart from family undertakings |
Some sector schedules set their own overtime lines. In the Act, night is at least 11 consecutive hours including 10 pm to 5 am, and a young person is under 18.
An employer may not discriminate on sex in pay. The Equal Pay Act requires equal pay for equal work, and the employer carries the burden of proof. We check which schedule your role falls into before the offer goes out.
How does probation work in Saint Kitts and Nevis?
Probation is up to three months, or up to four weeks for household employment.
During probation the employer can end the job in writing without notice, unless the contract says otherwise.
The Protection of Employment Act does not apply to a temporary worker, meaning someone whose employment does not go beyond the probationary period, except for the maternity leave qualification. Put the probation period in writing, because the written terms must state it.
The termination guide has the rules after probation.
How much leave do employees get in Saint Kitts and Nevis?
Annual leave is at least 14 paid days for each year of employment, not counting Sundays and public holidays.
Maternity leave is 13 weeks, and sickness cover comes mainly from the Social Security Board.
| Leave | Entitlement |
|---|---|
| Annual leave | 14 days a year, with pay, not counting Sundays and public holidays |
| A year of employment | 238 days worked for weekly, fortnightly, monthly or yearly paid workers, and 154 for hourly, daily or piece-work paid workers |
| Taking the leave | Within three months after it accrues, with at least 7 days' notice of the start date |
| Maternity leave | 13 weeks, after 150 days worked for the employer in the previous year |
| Sickness benefit | 65% of average weekly wages, for up to 26 weeks, after 26 contribution weeks |
| Paternity leave | None in the Acts we read |
Sundays and public holidays that fall inside the annual leave add one day each, and unused leave is paid when the job ends. We found no statutory employer-paid sick leave in the Acts we read, so any paid sick leave beyond the Social Security benefit is a matter of contract. We confirm in the contract how each public holiday is paid.
What maternity leave must you give in Saint Kitts and Nevis?
An employee is entitled to 13 weeks of maternity leave, with at least two weeks up to and including the expected date of the birth and at least six weeks from that date.
She must have worked for you for 150 days in the previous year.
She gives notice before the birth that she expects to be confined within six weeks, and tells the employer the date of the birth afterwards. Medically certified illness from the pregnancy or the birth can add up to three months of leave. An employer cannot give notice of dismissal during maternity leave, and cannot end a job because of pregnancy, with the burden of proof on the employer.
The Social Security maternity allowance is 65% of average weekly wages for up to 13 weeks, and needs 39 contribution weeks. Where no benefit is payable for some of the leave, the employer pays at the Social Security rate. The Acts we read have no statutory paternity leave.
Does a hire need a work permit in Saint Kitts and Nevis?
A person who is not a citizen, an approved CARICOM citizen or a citizen of a Protocol Member State needs a written work permit to take a job.
An employer who engages such a person without a permit commits an offence.
The application is made while the future employee is outside the Federation, except for renewals. The Minister can attach conditions, change them or revoke the permit, and can ask the employer for security covering the cost of sending the worker and any dependants home. The permit is of no effect until the security is given.
We check each hire's right to work before the contract is signed.
