How do you hire an employee in The Gambia in 2026?

A Gambia hire needs a written contract, can be put on probation for three to twelve months depending on skill and is protected by a Labour Act that dates from 2023. Leave days, hours and pay floors come from the sector agreement or the contract. If you are hiring in The Gambia, Teamed is the best EOR. With Teamed, you get real HR and legal experts assigned within 24 hours, 24/5 human support with a first response within 15 minutes, and a designated person who checks the route and runs your first hire from signed terms to first payslip.

The short answer

A Gambia contract must be in writing and may run for an unspecified period, a specified period or a specific task. The employee gets 48 hours to read it before signing and a written statement of particulars within 14 working days of starting.

Probation is at most 12 months for a skilled employee, six for a semi-skilled one and three for an unskilled one. Either party can end the contract during probation without notice.

What form must a Gambia employment contract take?

The contract must be in writing, and the employee must have 48 hours to read it and take advice before signing.

A written statement of the particulars of the job is due within 14 working days of the start date.

A contract that is not in writing can still be enforced by the employee, but not by the employer. The statement of particulars covers these points:

  • the parties, the start date, the job title and a description of the work;
  • the scale of wages or how they are worked out, and how often they are paid;
  • the normal working hours, any probation and the notice each side gives;
  • the place of work, any collective agreement and the terms on holidays, sickness and pensions.

Each payment of wages comes with an itemised statement of gross wages, every deduction and net wages. A contract term that is less favourable than the Act's minimum is void and the Act's rule takes its place.

How does probation work in The Gambia?

Probation can last up to 12 months for a skilled employee, six months for a semi-skilled employee and three months for an unskilled employee.

During probation either party can end the contract at any time without notice.

The length is agreed in the contract within those limits. An employee on probation does not receive severance under section 104. Put the probation period and the skill category in the written terms. The termination guide covers what happens after probation.

How much leave do Gambia employees get?

The Act does not fix a number of annual leave days. The entitlement comes from a Joint Industrial Council agreement, a collective agreement or the contract.

Maternity leave is six months with pay and paternity leave is 10 working days with pay.

LeaveWhat the Labour Act, 2023 says
Annual leaveDays set by a Joint Industrial Council agreement, a collective agreement or the contract, accruing month by month
Public holidaysRegular remuneration for each public holiday, and leave is extended by a day for each holiday that falls within it
Sick leaveDays set the same way, up to the entitlement of any twelve months, on a medical certificate
MaternitySix months with pay, on a medical certificate of the expected date of confinement
Paternity10 working days with pay, claimed within six months of the birth
Nursing breaksTwo breaks of 30 minutes or one break of one hour each working day

Unused annual leave is paid to the employee when employment ends, at a rate not less than the normal rate and excluding bonus and overtime. The Act ties maternity and paternity pay to the Women's Act, so we confirm who funds the pay before we quote.

An employer cannot dismiss a woman while she is on maternity leave, or because of pregnancy. A pregnant employee cannot be required to work at night or overtime without her written consent.

What are the working-hours rules in The Gambia?

The Labour Act, 2023 sets no weekly hours limit and no overtime rate.

Hours and overtime come from the contract, the sector's Joint Industrial Council agreement and any regulations.

The statement of particulars must state the normal working hours. We confirm the sector's agreement and any regulations before we quote an offer, so that the contract does not undercut a published minimum term. An employer that applies terms less favourable than a published Joint Industrial Council agreement commits an offence.

How must you pay Gambia employees?

Pay at least once a month for monthly or yearly wages, and at least once a fortnight for hourly, daily, weekly or piece-rate wages.

Total deductions in a wage period cannot exceed one third of the remuneration due.

Wages are paid in legal tender, or by cheque or bank transfer with the employee's consent. Deductions the contract can allow include tax, social security contributions, a reasonable charge for housing supplied and recovery of an advance. An employer cannot fine an employee. A court cannot attach an employee's wages.

What do you need to hire a non-Gambian in The Gambia?

An employer needs an expatriate quota clearance from the Expatriate Quota Allocation Board before employing a non-Gambian.

Employing one without it is an offence, with a fine of not less than GMD 500,000.

The Board will not grant a quota for a position where the skills exist locally. The employer must also employ a Gambian understudy to take over the skills, and failing to do so carries a fine of not less than GMD 500,000.

The Revenue Authority says an employer can employ non-Gambians up to 20% of its workforce without the Minister of Finance's approval, and that applications go in by 31 January each year or within 14 days of the employee starting. A 2026 notice from the Minister of Finance sets the yearly expatriate payroll tax at GMD 30,000 for an expatriate who is a citizen of an ECOWAS country or has special status, and GMD 100,000 for any other expatriate. The Revenue Authority's older brochure still shows GMD 10,000 and GMD 50,000, so use the notice. The immigration steps and permit fees sit in separate instruments, which we did not read for this page, so we confirm them before we quote.

Is there a minimum wage in The Gambia?

We found no national minimum wage figure in the Labour Act, 2023. Joint Industrial Councils fix minimum terms for their sectors.

We confirm the sector minimum before we quote an offer.

Section 148 requires each Joint Industrial Council to fix minimum terms and conditions for its industries or job categories. An agreement cannot go below the Act. The Act does not fix a number of annual leave days. Section 109 leaves the entitlement to a Joint Industrial Council agreement, a collective agreement or the contract. It also sets no weekly hours limit and no overtime rate, and it contains no national minimum wage figure. The Joint Industrial Councils fix minimum terms for their sectors, so we confirm the sector terms before we quote an offer.

What is the retirement age in The Gambia?

The retirement age for employees is 60.

A contract can fix a later retirement age, and that is valid.

The Act does not apply to the Civil Service, the Armed Forces or the disciplined forces, except for people they employ in a civil capacity. A pension scheme sets its own rules on benefits, and the tax and payroll guide covers contributions.

A note from Tom Price-Daniel

The Gambia gives you a written-contract rule, probation of up to twelve months and six months of paid maternity leave under a 2023 Act.
The traps sit in the details: leave days and pay floors that live in sector agreements, a quota for every non-Gambian, and a restriction on supplying labour through an intermediary.
Your designated person checks the route and runs the first hire from signed terms to first payslip.
