Gabon's legal working week is 40 hours. Night work runs from 21:00 to 06:00 and cannot exceed 8 consecutive hours. Employees earn 2 working days of paid leave for each month of service.
Probation is capped at 6 months for managers, 3 for technicians and supervisors and 1 for other staff. Maternity leave is 14 weeks and paternity leave is 3 days.
What are the working-hours rules in Gabon?
The legal working week is 40 hours in all public and private establishments.
Hours beyond it are overtime, paid at a premium that regulations and collective agreements set.
| Rule | What the Labour Code sets |
|---|---|
| Legal working week | 40 hours |
| Agricultural enterprises | 2,400 hours a year, set in sector agreements |
| Night work | 21:00 to 06:00, no more than 8 consecutive hours |
| Weekly rest | At least 24 consecutive hours, in principle on Sunday |
The Code does not print the overtime premium. It leaves the rate to regulations and to collective agreements, so we confirm the rate for the sector before we quote a cost. Overtime needs a notice to the staff delegates and information to the labour inspector.
Night-work rates sit in sector agreements. Before night hours start, the employer must consult the workers' representatives.
How does probation work in Gabon?
Probation must be in writing and is capped, renewal included, at 6 months for managers, 3 months for technicians and supervisors and 1 month for other staff.
Either side can end it without notice or indemnity.
The cap counts days actually worked. A worker kept on after probation without a new contract is treated as permanent from the first day of the trial. Unused paid leave is still due when probation ends early.
If a worker was recruited away from the workplace, the employer pays the return journey when either side ends probation.
Which employment contracts can you use in Gabon?
A permanent contract is the default. A fixed-term contract with a set end date cannot run beyond 2 years, renewals included.
A fixed-term contract cannot fill a permanent role.
A fixed-term contract must be in writing and state its purpose. If it runs past 2 years, or carries on after its term, it becomes permanent. It ends at its term with no end-of-contract indemnity, but paid-leave pay is still due.
The Code also recognises task contracts, seasonal contracts, part-time and intermittent contracts, and temporary-agency missions. A contract can be oral, but a certificate of medical fitness is required, and a written contract needs no stamp duty.
How much leave do Gabonese employees get?
Annual leave builds at 2 working days for each month of service, which is 24 working days a year.
The right to take it opens after 12 months of effective presence.
| Leave | Entitlement |
|---|---|
| Annual leave | 2 working days per month of service |
| Mothers | 1 extra day a year for each child under 16 |
| Seniority | Leave grows with seniority, up to 2 months at most |
| Family events | Up to 10 days of exceptional permission that cannot be deducted from leave |
| Maternity leave | 14 weeks, 6 before and 8 after the birth |
| Paternity leave | 3 consecutive days, with pay maintained |
The 24 days a year is our arithmetic from the monthly rate. Working days are every day except Sundays and public holidays. Leave pay is at least the worker's average pay over the 12 months before leave. Public holidays are fixed by decree, and we confirm the calendar for the year.
What maternity leave must you give in Gabon?
A pregnant employee can suspend her contract for 14 consecutive weeks: 6 before the presumed date and 8 after the birth.
The social security fund, not the employer, bears her full salary and medical care.
She must declare the pregnancy in the first three months. The leave extends by 3 weeks for an illness resulting from pregnancy or childbirth, and by 3 weeks after the birth in multiple births. The CNSS pays her daily maternity allowance once she stops work.
An employer cannot dismiss a woman for pregnancy or childbirth. Dismissal while she is pregnant, or within 15 months after the birth, needs the labour inspector's prior authorisation. Breaks for nursing last 12 months from her return, at 2 hours a day for six months and then 1 hour a day.
What does a non-Gabonese hire need?
An employment authorisation from the labour minister, valid for one worker, one post and one company, for at most 2 years, renewable.
The minister has one month to decide, and the employer applies and pays a XAF 500,000 file fee.
| Job category | Quota of foreign workers |
|---|---|
| Managers (cadres) | 10% of the national employees in the category |
| Supervisors and senior technicians | 15% |
| Operational staff | 2% |
Nationals get priority at equal skills, and the Code allows foreign staff only for skills the local market cannot supply. The minister can grant exceptions to the quotas for high-technology work if a Gabonese counterpart is trained alongside, and renewal depends on that training plan being carried out.
Employing a foreigner without authorisation carries a fine of XAF 1,000,000 to 2,000,000, with 2 to 6 months in prison or either penalty. After a job ends, the employer must tell the labour inspector and immigration within 8 days.

Frequently asked questions
What is the monthly minimum wage in Gabon?
Gabon has two decree-set floors: the SMIG of XAF 80,000 a month (decree of 9 November 2006) and a monthly minimum income of XAF 150,000 for any worker whose gross monthly pay is lower (decree of 22 April 2010). We found no later decree when we checked on 21 October 2026.
How long can a probationary period last in Gabon?
Up to 6 months for managers, 3 months for technicians and supervisors and 1 month for other staff, renewal included. It must be in writing, and either side can end it without notice.
Is there a thirteenth-month payment in Gabon?
The Labour Code we read sets no thirteenth-month payment. A contract or collective agreement can add one, so check the sector agreement before you fix the contract.
Does Gabon have statutory paternity leave?
Yes. The Labour Code gives 3 consecutive days of paternity leave to a worker who has a birth certificate, with pay maintained for those days.
Can you hire a non-Gabonese worker in Gabon?
Yes, with an employment authorisation from the labour minister, valid for one worker, post and company for up to 2 years. Quotas apply by job category, and the file fee is XAF 500,000 per application or renewal.
Gabon gives you a 40-hour week, 24 working days of leave a year and 14 weeks of maternity leave that the social security fund pays.
The traps sit in the details: probation caps that differ by job category, and an authorisation and quota for every foreign hire.
Your designated person runs the first hire from signed terms to first payslip.
