Eswatini's Employment Act requires written authority from the Labour Commissioner to carry on a private employment agency, including supplying employers with persons for employment by them. So the route is checked first.
Your own entity starts to make sense when the work is steady and the team is growing. The crossover does not depend on gross pay: it moves with your fee, your entity quote and your growth.
Does Eswatini restrict supplying workers to an employer?
Yes, through a licence. No one may carry on a private employment agency without the Labour Commissioner's written authority.
The definition includes supplying employers with persons for employment by them.
The Employment Act says no person may carry on a private employment agency without the written authority of the Labour Commissioner (section 112). Section 110 defines that business to include supplying employers with persons for employment by them, and section 118 makes carrying it on without authority an offence, with a fine of up to E3,000, up to one year in prison, or both. Whether a particular arrangement falls inside that definition is a question for local lawyers, so Teamed's experts check the route first.
The same Part sets a scale of fees that the Labour Commissioner approves for charges to employers, and it makes it an offence to charge a job seeker a fee for finding work. The Act also licenses labour agents who recruit for foreign contracts of employment.
What does an employer of record do that you would otherwise do yourself?
An employer of record is the legal employer named in the contract. It issues the written terms, runs payroll and pays the PAYE.
You direct the work and keep the output.
In Eswatini that would include the monthly tax return by the 7th, the provident fund for a citizen and the Employment Act's rules on leave, probation and termination. Employer of record is a commercial label, not a legal category. The legal employer is the company named in the contract.
Whether an employer of record arrangement can run in Eswatini without breaching the agency rule is the route question above, and we answer it first.
What changes when you employ people directly in Eswatini?
You take on every employer duty yourself: tax withholding, the provident fund, written particulars, leave, notice and severance.
None of it is optional, and sector orders can change the wage floor.
- Income tax. Withholding in four bands from 20% to 33%, less the E8,200 rebate, returned by the 7th of the following month.
- Provident fund. For a citizen, up to E215 from the employer and E215 from the employee a month in 2026, paid within 21 days after month end.
- Written particulars. The Second Schedule form, signed and witnessed, within six weeks of the start.
- Leave and sick leave. At least two weeks of annual leave, and sick leave on full and half pay.
- Termination. Notice, severance of ten working days' wages for each completed year after the first, and a fair reason for any dismissal.
A direct employer also has to track the sector wage order. A non-citizen needs separate work permit checks, which we confirm before an offer.
When does your own Eswatini entity make sense?
When the work is steady, the team is growing and your entity quote beats the cost of the alternative.
Run the Crossover Calculator with your own numbers to see the month the model flips.
A higher gross pay rarely moves the crossover point much, because it lifts both costs together. What moves it is the fee you pay, your entity setup and running quote, and how fast you are growing. Headcount alone will not tell you where you cross.
Teamed tells you when you have crossed, and helps you move once the route is settled.
How does the move from contractor to employee to your own entity work?
Teamed's Graduation Model moves a worker from contractor to employee to your own entity on one platform where the route allows it.
For Eswatini the route check decides which steps are open.
Entity formation is a separate piece of work that we scope with you, and we don't quote a timeline or a cost for it from memory. The pricing page shows Teamed's starting rate, with zero FX markup in any currency.
How does Teamed advise on the right structure in Eswatini?
