# When is a final paycheck due in *West Virginia*?

West Virginia frames this as a question about the work rather than about the exit: wages for work already performed are due on the payday they would have been due anyway.

In West Virginia, on a discharge or a resignation, the employer must pay **wages due for work performed prior to the separation on or before the next regular payday on which the wages would otherwise be due and payable**, under [W. Va. Code 21-5-4](https://code.wvlegislature.gov/21-5-4/).

The statute scopes the obligation to work already performed, which is the clean way to think about it: separation does not accelerate the payday, it simply fixes what is owed on it.

West Virginia used to require accelerated payment on a discharge and no longer does. The current section aligns both routes on the ordinary payday, which is why older summaries of this state are unreliable.

## When must a final paycheck be paid after firing someone in West Virginia?

On or before the next regular payday on which those wages would otherwise be due and payable, under W. Va. Code 21-5-4(b).

Because the deadline is the payday the money would have fallen due on anyway, West Virginia almost never forces an off-cycle payment. The compliance risk here is the amount rather than the timing.

No. Section 21-5-4(b) covers a discharge and a resignation in the same sentence and gives them the same deadline.

That symmetry is deliberate and relatively recent. The state formerly imposed a tighter deadline on a discharge, so guidance written before the change overstates the obligation.
