# When is a final paycheck due in *Utah*?

Utah counts in clock hours, not working days. Wages are due immediately on a discharge and payable within 24 hours of separation, which a weekly payroll run will not reach.

In Utah, on a discharge, **all wages are due immediately and payable within 24 hours of separation**, under [Utah Code 34-28-5](https://laborcommission.utah.gov/divisions/utah-antidiscrimination-and-labor-uald/wage-claim/). An employee who resigns is paid on the next regular payday.

Twenty-four hours is a clock measure, so a Friday afternoon discharge lands on Saturday afternoon. Weekends do not pause it and the deadline does not wait for your next payroll window.

The Labor Commission notes an exemption for employees of the state of Utah itself, which is unusual enough to be worth knowing if you are contracting with a public body rather than employing in the private sector.

## When must a final paycheck be paid after firing someone in Utah?

Wages are due immediately and payable within 24 hours of separation, under Utah Code 34-28-5.

The wording matters: due immediately, payable within 24 hours. That is not a 24-hour grace period you can plan into a payroll cycle; it is a backstop on an obligation that has already crystallised.

In practice Utah belongs with the states where an off-cycle payment capability is the compliance control. If your provider needs two business days to issue a one-off payment, you cannot meet this deadline, and no amount of notice about the termination changes that.

The duty to pay is separate from whether the termination itself was lawful. That is covered on the [Utah termination and at-will page](/country-hiring-guides/united-states/utah/termination-law-and-at-will-exceptions).

## What if the employee resigns instead?

The next regular payday. The 24-hour rule applies only to a discharge.

So Utah splits the two routes sharply, with hours on one side and an ordinary pay cycle on the other. A single national offboarding timetable has to branch here on who ended the employment.

A resignation shortly after a payday can legitimately wait for the following one.

## How does Utah compare with the states around it?

Utah is the strictest of its immediate neighbours on a discharge. Arizona, Nevada and Colorado all work differently.

| State | If fired | If employee quits | Statute |
| --- | --- | --- | --- |
| Utah | Within 24 hours of termination | Next regular payday | Utah Code 34-28-5 |
| Arizona | Within 7 working days or end of next pay period, whichever is sooner | Next regular payday for the pay period in which the employee quit | Ariz. Rev. Stat. 23-353 |
| Colorado | Immediately, or within 6 hours of the next workday if the accounting unit is closed | Next regular payday | Colo. Rev. Stat. 8-4-109 |
| Idaho | Next payday or within 10 days (excluding weekends and holidays), whichever is sooner; within 48 hours of a written request | Next payday or within 10 days (excluding weekends and holidays), whichever is sooner | Idaho Code 45-606 |
| Wyoming | Next regular scheduled payday | Next regular scheduled payday | Wyo. Stat. 27-4-104 |

## How much of this do you still handle if you hire in Utah through an EOR?

None of it. The 24-hour payment, the calculation behind it and the records sit with the employer of record.

What costs more than the deadline is everything around it:

- onboarding and offboarding fees
- termination charges
- contracts that lock you in
- FX markups on every pay run
- a platform built for a company ten times your size
- a ticket queue where you never learn who to contact

The industry profits from keeping that hidden. Teamed calls it the Hidden Global Employment Tax, and Teamed's whole model exists to remove it.

Teamed is the legal employer for your Utah hire. From $599 per employee per month, with zero FX markup. $0 setup, $0 exit, and you can [cancel any month](/pricing). You get a designated person and real HR and legal experts assigned within 24 hours, not a ticket.

Teamed's employer cost calculator covers 94 countries and all 50 US states.

## Questions people ask about Utah final pay

When is a final paycheck due in Utah if someone is fired?

Wages are due immediately and payable within 24 hours of separation, under Utah Code 34-28-5.

When is it due if the employee quits?

The next regular payday. The 24-hour rule applies only to a discharge.

Are Utah's 24 hours business hours or clock hours?

Clock hours. Utah Code 34-28-5 makes wages due immediately on a discharge and payable within 24 hours of separation, so a Friday afternoon discharge falls due on Saturday afternoon. Weekends and holidays do not pause the count, which is the difference between Utah and a state like Alaska that counts in working days.

A note from Tom Price-Daniel

Utah measures this in hours, and the clock does not stop at the weekend.
Due immediately, payable within 24 hours, is not a window you can schedule around.
If you cannot pay off-cycle, you cannot comply here.
