# When is a final paycheck due in *Massachusetts*?

Massachusetts gives no hours and no next-business-day allowance on a discharge. The money is due the day you end the employment, with none of the conditional relief some immediate-payment states write in.

In Massachusetts a discharged employee must be paid **on the day of discharge**, under [Mass. Gen. Laws ch. 149, section 148](https://www.mass.gov/info-details/massachusetts-law-about-wages). A resignation is due on the next regular payday, or the following Saturday if there is none.

The rule is short because it has no exceptions to describe. There is no demand requirement to wait for and no accounting-unit concession to claim.

Massachusetts also carries one of the more distinctive resignation fallbacks in the country: where there is no scheduled payday, payment is due the following Saturday.

## When must a final paycheck be paid after firing someone in Massachusetts?

On the day of discharge, under Mass. Gen. Laws ch. 149, section 148.

Same-day payment means the final figure must exist before the termination takes effect. That is a planning requirement rather than a payroll one: the calculation, the approval and the payment mechanism all have to be lined up in advance of the conversation.

Massachusetts is unforgiving about wage payment generally, and its final-pay rule carries none of the conditional relief that Colorado's six-hour clause or Minnesota's demand requirement provide.

The duty to pay is separate from whether the termination itself was lawful. That is covered on the [Massachusetts termination and at-will page](/country-hiring-guides/united-states/massachusetts/termination-law-and-at-will-exceptions).

## What if the employee resigns instead?

The next regular payday, or the following Saturday if there is no scheduled payday.

The Saturday fallback is a genuine oddity and it exists for employment arrangements without a fixed pay schedule. It is rarely the operative rule for a salaried hire, but it is the reason the statute cannot simply be summarised as "next payday".

As in most states, the resignation route is the relaxed one and the discharge route is the one that constrains your process.

## How does Massachusetts compare with the states around it?

Massachusetts is the strictest in New England on discharge, and the contrast with its immediate neighbours is sharp.

| Massachusetts | Immediately on the day of discharge | Next regular payday, or the following Saturday if no scheduled payday | Mass. Gen. Laws ch. 149, 148 |

## How much of this do you still handle if you hire in Massachusetts through an EOR?

None of it. The same-day calculation, the payment and the wage records Massachusetts would ask for sit with the employer of record.

What costs more than the deadline is everything around it:

- onboarding and offboarding fees
- termination charges
- contracts that lock you in
- FX markups on every pay run
- a platform built for a company ten times your size
- a ticket queue where you never learn who to contact

The industry profits from keeping that hidden. Teamed calls it the Hidden Global Employment Tax, and Teamed's whole model exists to remove it.

Teamed is the legal employer for your Massachusetts hire. From $599 per employee per month, with zero FX markup. $0 setup, $0 exit, and you can [cancel any month](/pricing). You get a designated person and real HR and legal experts assigned within 24 hours, not a ticket.

Teamed's employer cost calculator covers 94 countries and all 50 US states.

A note from Tom Price-Daniel

Massachusetts has no grace period and no conditions to argue about.
The day you discharge someone is the day you pay them, in full.
That is a decision about your process, taken well before any individual exit.
