# When is a final paycheck due in *Kansas*?

Kansas writes its deadline counterfactually and then adds a provision almost no other state has: if the departing employee asks, you may pay by post, provided the envelope is postmarked inside the deadline.

In Kansas, on a discharge or a resignation, the employer must pay earned wages **not later than the next regular payday upon which the employee would have been paid if still employed**, under [K.S.A. 44-315](https://ksrevisor.gov/statutes/chapters/ch44/044_003_0015.html). The same deadline covers both routes.

The reference point is that individual's own payday rather than your general pay calendar, which matters wherever pay frequency differs by role. Kansas shares that construction with Virginia and West Virginia and almost nobody else.

The statute also permits payment through the regular pay channels or by mail postmarked within the deadline, if the employee requests it. That is a practical answer to the problem of a departing employee who is no longer on site.

## When must a final paycheck be paid after firing someone in Kansas?

By the next regular payday on which the employee would have been paid if still employed, under K.S.A. 44-315(a).

Read literally, which is how it should be read, this points at the schedule that applied to that person. An employee paid monthly while the rest of your staff are paid fortnightly has the monthly date as their deadline.

The mail provision is worth building into your offboarding rather than discovering later: it is available on the employee's request, and the test is the postmark rather than the delivery date.

## Is it different if the employee resigns?

No. K.S.A. 44-315(a) applies the same deadline whether the employer discharged the employee or the employee quit or resigned.

One standard for both routes makes Kansas simple to operate, and it means the burden of explaining a delay does not shift depending on who ended the job.

Subsection (b) attaches damages where an employer wilfully fails to pay, so the consequence of missing the date is not merely the delay itself.
