# When is a final paycheck due in *Colorado*?

Colorado writes an unusually precise concession into an otherwise immediate rule: if your payroll function is shut when you fire someone, you get six hours of the next working day, and not a minute of the day after.

In Colorado a discharged employee must be paid **immediately**, or within six hours of the next workday if the accounting unit was closed, under [Colo. Rev. Stat. 8-4-109](https://cdle.colorado.gov/dlss/labor-laws-by-topic/wage-and-hour-laws-including-paid-sick-leave). A resignation is due on the next regular payday.

The six-hour allowance is narrow and conditional. It exists because the accounting unit was closed, not because the calculation was difficult or the approver was unavailable.

Colorado is also one of the states where the two routes diverge sharply: the discharge deadline is measured in hours and the resignation deadline is simply the next regular payday.

## When must a final paycheck be paid after firing someone in Colorado?

Immediately. If the employer's accounting unit is closed at the time of discharge, within six hours of the start of the next workday, under Colo. Rev. Stat. 8-4-109.

The six-hour window is the detail worth knowing, and it is worth reading narrowly. It is triggered by the accounting unit being closed, so an employer whose payroll function was open and simply did not act has not earned it.

Six hours into the next workday is a tight extension. A Friday-evening termination with a closed payroll means early Monday afternoon, not Monday close of business and not Tuesday.

The duty to pay is separate from whether the termination itself was lawful. That is covered on the [Colorado termination and at-will page](/country-hiring-guides/united-states/colorado/termination-law-and-at-will-exceptions).

## What if the employee resigns instead?

The next regular payday. The immediate and six-hour rules apply only to discharges.

So the gap between the two routes in Colorado is one of the widest in the country: hours on one side, a normal pay cycle on the other.

If you operate one offboarding timetable everywhere, Colorado is a state where it has to branch on who ended the employment.

## How does Colorado compare with the states around it?

Colorado sits with the immediate-payment states on discharge while its neighbours mostly do not.

## How much of this do you still handle if you hire in Colorado through an EOR?

None of it. The immediate payment, the six-hour judgement and the payroll capability behind both sit with the employer of record.

What costs more than the deadline is everything around it:

- onboarding and offboarding fees
- termination charges
- contracts that lock you in
- FX markups on every pay run
- a platform built for a company ten times your size
- a ticket queue where you never learn who to contact

The industry profits from keeping that hidden. Teamed calls it the Hidden Global Employment Tax, and Teamed's whole model exists to remove it.

Teamed is the legal employer for your Colorado hire. From $599 per employee per month, with zero FX markup. $0 setup, $0 exit, and you can [cancel any month](/pricing). You get a designated person and real HR and legal experts assigned within 24 hours, not a ticket.

Teamed's employer cost calculator covers 94 countries and all 50 US states.

## Questions people ask about Colorado final pay

When is a final paycheck due in Colorado if someone is fired?

Immediately. If the employer's accounting unit is closed at the time of discharge, within six hours of the start of the next workday, under Colo. Rev. Stat. 8-4-109.

When is it due if the employee quits?

The next regular payday. The immediate and six-hour rules apply only to discharges.

When does Colorado's six-hour final pay allowance apply?

Only when the employer's accounting unit is closed at the time of the discharge. Colo. Rev. Stat. 8-4-109 then allows payment within six hours of the start of the next workday. It is not a general grace period, so an employer whose payroll function was open and did not act cannot rely on it.

A note from Tom Price-Daniel

Colorado wrote the exception most states leave out, and then made it small.
Six hours into the next workday, and only because your payroll office was shut.
If you cannot pay inside that, the rule you are breaking is the immediate one.
