The short answer

The ordinary week is 40 hours and the ordinary day is 8 hours, not counting the meal interval. Overtime pays at least 1.5 times the hourly wage.

Employees earn 14 working days of paid annual leave a year for the first five years and 21 working days after that. Maternity leave is at least 13 weeks.

## What must a written contract cover in Saint Lucia?

Within 14 days of the start, an employer may prepare a written contract that describes the agreed terms. If there is no written contract, the employer must explain the terms to the employee.

An employee without a written contract can ask for one in writing and must receive it within one month.

The Act sets out the particulars a written contract covers, and a term that gives the employee less than the Act is void. The employer and employee sign it, and the employer gives the employee a signed copy. A material falsehood in a contract is an offence with a fine of up to EC$10,000.

A contract may run without a time limit, for a specified period or for a specific task. A contract for a specified period or task that fills a post in the normal and permanent activity of the business for over two years is treated as a contract without a time limit. After 12 weeks of continuous employment, other contracts are treated that way too.

## What are the working-hours rules in Saint Lucia?

The ordinary week is 40 hours and the ordinary day is 8 hours, not counting the meal interval.

Overtime needs an agreement and pays at least 1.5 times the hourly wage, or twice on a Sunday or public holiday.

| Rule | What the Labour Act sets |
| --- | --- |
| Ordinary week | 40 hours, not counting overtime. Managerial employees are outside the limit |
| Hospitality industry | More than 40 hours is allowed, up to 80 hours over two weeks, not counting overtime |
| Ordinary day | 8 hours, not counting the meal interval. Flexible hours can be agreed up to 40 a week |
| Rest | No more than 6 consecutive days without 24 consecutive hours of rest |
| Meal interval | At least 1 hour after 5 hours of continuous work, which can be split by agreement, with one break of half an hour |
| Overtime | By agreement, at least 1.5 times the hourly wage, and 2 times on a Sunday or public holiday |

An employee and employer can agree time off instead of overtime pay. The Act also lets a hospitality shift worker take extra rest in place of overtime pay after an emergency. We check which rules apply to your role before the offer goes out.

## How does probation work in Saint Lucia?

A new employee can serve a probationary period of up to 12 weeks, or a shorter or longer period that the parties agree.

During it, either side can end the job for any reason.

A dismissal during probation does not count as an unfair dismissal. The employer must assess the employee during probation and tell them the result before it ends. A probation longer than 12 weeks does not take away the rights that start after 12 weeks of continuous employment.

The termination guide has the rules after probation.

## How much leave do employees get in Saint Lucia?

Annual leave is 14 working days with pay for employment of up to five years, and 21 working days after five years.

Paid sick leave starts after six months of continuous service, and maternity leave is at least 13 weeks.

| Leave | Entitlement |
| --- | --- |
| Annual leave, up to 5 years | 14 working days a year, with pay |
| Annual leave, over 5 years | 21 working days a year, with pay |
| Public holidays | 13 named in the Bank Holidays Act, plus any the Governor General proclaims |
| Sick leave with pay | After 6 months of continuous service. Up to 2 days at a time, and 12 days a year, without a certificate |
| Maternity leave | At least 13 weeks, with at least 6 weeks before and 6 weeks after the birth |
| Maternity leave without pay | 6 weeks where the employee has under 12 months of service |

Annual leave is earned at the end of each year of employment, counted on Monday to Friday. The employer gives at least 7 days' notice of the start date, and leave is taken within 6 months of accruing unless the parties agree to postpone it. Annual leave grows by one day for each public holiday inside it, and unused leave is paid when the job ends.

The 13 named holidays are 1 January, 2 January, Independence Day on 22 February, Good Friday, Easter Monday and Whit Monday. The rest are Labour Day on 1 May, Corpus Christi, Emancipation Day on 1 August, Thanksgiving Day, Saint Lucia Day on 13 December, Christmas Day and 26 December. A holiday that falls on a Sunday moves to the Monday.

The Act pays overtime at double the hourly wage for work on a public holiday that the employee agrees to. A daily-paid worker who works the day before and the day after is paid for the holiday. A medical certificate is needed from the third day of sick leave.

## What maternity leave must you give in Saint Lucia?

An employee is entitled to maternity leave of the length set by the National Insurance Corporation Act, and never less than 13 weeks.

She gives at least three weeks' notice, and an employer cannot dismiss her because she is pregnant.

At least six weeks come before the birth and at least six weeks after, unless she chooses to return earlier. To return to the same job or an equivalent one, she needs 12 months of continuous service at the expected confinement, and a medical certificate. An employee with under 12 months of service can take six weeks without pay.

The National Insurance Corporation pays a maternity allowance of 65% of the average of her insurable earnings over the 10 months before the month of confinement, for up to three months. It also pays a grant of EC$600, and we confirm her contribution record before the first claim.

## Does a hire need a work permit in Saint Lucia?

A foreign national needs a valid work permit, or an exemption, to be employed in Saint Lucia.

An employer who breaks the rule can be fined up to EC$5,000 or imprisoned for up to one year.

The Minister can grant a permit with or without conditions, and the application carries a prescribed fee. Permanent residents and some children of citizens are not treated as foreign nationals. Some groups are exempt under the Act or other laws, so we check the route for each hire.

We check each hire's right to work before the contract is signed.

## How does Teamed help with a Saint Lucia hire from offer to contract?

Teamed's **real HR and legal experts** check the right route for your Saint Lucia hire first: employer of record, contractor or your own entity.

Then a designated person takes you through the contract terms.

The experts apply the Labour Act's hours, probation and leave rules to the contract you choose, and you direct the work.

The check is part of every plan and comes before any contract is signed. Contractor, employer-of-record and own-entity routes run on **one platform**, so a change of route does not mean a change of provider.

1. **Agree the offer**: Role, gross pay and contracted hours. Check the gross pay against the national minimum wage.
2. **Check the route**: Experts confirm whether employer of record, contractor or your own entity fits, and whether a work permit is needed.
3. **Settle the contract terms**: Hours, probation, leave and the written terms are agreed before the start date.
4. **Plan payroll**: National Insurance and income tax registrations are set up for the chosen route before the first payslip.

A note from Tom Price-Daniel

Saint Lucia sets a 40-hour week, pays overtime at 1.5 times, and gives at least 13 weeks of maternity leave.
The traps sit in the details: fixed-term contracts that count as permanent, and a minimum wage that sits on top of allowances.
Your designated person takes you through the contract terms before the first offer goes out.
