The short answer

A monthly-paid employee is owed at least one month of notice, or two months after more than ten years. In probation there is no notice. The notice must be in writing and give the reason.

After probation, an employer can usually end a job only for serious misconduct, repeated misconduct or poor performance after a written warning, or redundancy. Redundancy benefit starts at 3 years.

## How much notice must you give in Dominica?

A monthly-paid employee is owed at least one month of notice, or two months after more than ten years of continuous employment.

An employee paid at shorter intervals is owed one to four weeks, by length of service.

| Situation | Employer's notice |
| --- | --- |
| Within probation | None, if the employee has not shown they can do the job |
| Monthly paid, under 10 years | At least 1 month |
| Monthly paid, over 10 years | At least 2 months |
| Paid more often, under 2 years | At least 1 week |
| Paid more often, 2 to 5 years | At least 2 weeks |
| Paid more often, over 5 years | At least 4 weeks |
| Serious misconduct | None required |

An employer can pay the wages for the notice period instead of having it worked. An employee on monthly pay gives one month to leave, and one week if paid more often. The employer must give a reasonable amount of time off to look for new work during the notice.

## When can you dismiss in Dominica?

Only on the grounds the Protection of Employment Act lists: probation, serious misconduct, repeated misconduct or poor performance after a written warning, or redundancy.

The notice must be in writing, state the date and give the reason, and the reason cannot be changed later.

Serious misconduct, such as conduct that leaves the employer no reasonable course but to end the job, allows dismissal without notice. For lesser misconduct, the employer gives a written warning. If the employee repeats the same or substantially the same misconduct within six months, the employer may dismiss.

For poor performance, a written warning starts a three-month period in which the employee can show they perform satisfactorily. Trade union membership, a good-faith complaint and protected characteristics such as race, sex or religion are not misconduct. In a challenge, the employer carries the burden of proving it was entitled to dismiss.

## When is redundancy benefit payable in Dominica?

Redundancy benefit is payable when the employer ends the job for a redundancy reason the Act lists, after 3 years of continuous employment.

It runs from 3 weeks' pay at 3 years up to a cap of 52 weeks' pay.

| Service | Redundancy benefit |
| --- | --- |
| Up to 5 years | 1 week's pay for each year, plus 2 weeks' pay for each year beyond the third |
| Over 5 and up to 10 years | 9 weeks' pay, plus 2 weeks' pay for each year beyond the fifth |
| Over 10 years | 19 weeks' pay, plus 3 weeks' pay for each year beyond the tenth |
| Maximum | 52 weeks' pay |

On our arithmetic that is 3 weeks at 3 years, 9 weeks at 5 years and 19 weeks at 10 years, and the cap is reached at 21 years. A part year counts as a quarter, half, three quarters or a full year. The employer pays it. Employers contribute to a Redundancy Benefits Fund, and Dominica Social Security administers the fund for the Ministry of Labour.

The Act's redundancy reasons include modernising or mechanising the business, closing or selling all or part of it, reorganising for efficiency, a falling need for a category of employees, and reduced operations because of economic conditions. The benefit is not payable if the employee unreasonably refuses suitable alternative work. Managers who hire and dismiss, close family of the employer, state employees and some domestic workers are outside the Act.

## What happens if a Dominica dismissal is challenged?

The employee or union complains to the Minister, who can send the matter to the Labour Commissioner to settle.

If it is not settled within 21 days, the Minister may refer it to the Industrial Relations Tribunal, which can order reinstatement or compensation.

The Tribunal's compensation is not more than the remuneration the employee would have been paid but for the dismissal, taking account of age, length of service, dependants and prospects of other work. If reinstatement is not practicable, it can order compensation in place of it. An employer who cannot lawfully end a job can apply to the Tribunal for leave to do so.

Plan the process, the reasons and the record before you end a contract. The written warning and the written notice with its reason are the documents the Tribunal will ask for.

## Frequently asked questions

How much notice does an employer give in Dominica?

At least one month for a monthly-paid employee, or two months after more than ten years. For employees paid more often it is one week under two years, two weeks from two to five years and four weeks over five. An employer can pay the wages instead of having the notice worked.

Is redundancy benefit payable on every termination in Dominica?

No. It is payable only when the employer ends the job for a redundancy reason the Act lists, after 3 years of continuous employment. It is capped at 52 weeks' pay.

Can you dismiss without a reason in Dominica?

Only during probation, which is up to six months, and then only if the employee has not shown they can do the job satisfactorily. After probation, the notice must be in writing and give a listed reason.

What must an employer do before dismissing for poor performance?

Give a written warning that describes the problem and the action to be taken. If the employee does not show satisfactory performance within three months of the warning, the employer may terminate.

A note from Tom Price-Daniel

Dominica ties notice to the pay period, lists the grounds for dismissal and pays redundancy benefit after three years.
The written warning and the written notice with its reason are the documents that decide most challenges.
Call your designated person before you serve notice, not after.

A note on this page.

This is a guide, not legal, tax or accounting advice. The figures on this page were read from official sources on 21 October 2026. They come from the Protection of Employment Act, the Labour Contracts Act and the Labour Standards Act in the Revised Laws of Dominica, and from the Labour Standards (Minimum Wage) Order 2025. They also come from the Dominica Social Security contribution tables and guidance, the Inland Revenue Division's tax pages and the Ministry of Labour. The Revised Laws text we could read is the 1990 revision with amendments to 1991, and the Ministry refers to a 2017 revision, so we confirm for any later change before relying on a rule. The government has announced a flat 10% income tax from 1 January 2027 that was not law when we checked. Confirm current requirements with the Labour Division, Dominica Social Security, the Inland Revenue Division and a qualified adviser before relying on any figure.
