The short answer

Statutory notice is one week for service from two weeks to six months, two weeks to two years, four weeks to five years and eight weeks beyond that.

Severance starts at five years of continuous service. An employer can dismiss without notice or severance only for good and sufficient cause or gross misconduct.

## How much notice must you give in Belize?

Notice scales with service, from one week to eight weeks. The first two weeks of any job can be ended at will.

Either side can agree a longer period.

| Continuous service | Notice |
| --- | --- |
| First 2 weeks | None |
| More than 2 weeks, up to 6 months | 1 week |
| More than 6 months, up to 2 years | 2 weeks |
| More than 2 years, up to 5 years | 4 weeks |
| More than 5 years | 8 weeks |

An employer can pay the wages and benefits for the notice period instead of working it. An employer who gives no notice owes the wages for the notice period, and a worker who gives none owes half those wages. An employer cannot give notice while the worker is on lawful leave.

## When can you dismiss without notice in Belize?

Only for good and sufficient cause, which includes misconduct, wilful disobedience, lack of warranted skill, habitual neglect of duties and absence without reason.

Gross misconduct allows summary dismissal without notice or severance.

The Labour Act also lists reasons that never count as good cause. They include union membership, filing a complaint against an employer, race, sex, religion, disability, age, HIV status, temporary illness or injury, and pregnancy or absence on maternity leave.

A worker can also end the contract without notice where the employer's conduct has made continuing unreasonable, and is then treated as unfairly dismissed.

## When is severance payable in Belize?

Severance starts at five years of continuous service and is paid when the employer ends the job or the worker retires at 60 or on medical grounds.

It is one week's wages per complete year at five to ten years.

| Continuous service | Severance |
| --- | --- |
| Under 5 years | None under the Labour Act |
| 5 to 10 years | 1 week's wages per complete year |
| Over 10 years | 2 weeks' wages per complete year for service since 1 May 2011, and 1 week for service before it |

A worker with at least ten years of continuous service who resigns is eligible for a gratuity equal to severance pay. Summary dismissal for gross misconduct carries no severance.

## What must you do before a redundancy in Belize?

Give the required notice, and inform the recognised union or workers' representative and the Labour Commissioner no later than one month after the circumstances arise.

The notice must name the reasons and the people affected.

Redundancy covers modernisation, closing or selling the business, reorganisation to improve efficiency, and reduced work from economic conditions. Tell the Commissioner the reasons, the names and categories of those affected, the period over which the terminations will run and the claims the workers are owed.

## What happens if a Belize dismissal is challenged?

The Labour Complaint Tribunal considers reinstatement or re-engagement first.

Compensation is the alternative, set at what is just and equitable.

The worker must prove the complaint on a balance of probabilities, which means showing it is more likely than not. If it is proved, the Tribunal can order reinstatement, re-engagement, compensation or other remedies. It weighs the loss sustained and how far the worker contributed to the dismissal. Plan the process, the reasons and the record before you end a contract.

## Frequently asked questions

How much notice does an employer give in Belize?

None in the first two weeks, then one week up to six months, two weeks to two years, four weeks to five years and eight weeks beyond five years. An employer can pay in lieu of notice.

Is severance payable on every termination in Belize?

No. It starts at five years of continuous service, and an employer can dismiss for gross misconduct without notice or severance. Between five and ten years it is one week's wages per complete year.

Can you dismiss a pregnant employee in Belize?

Not for pregnancy. The Labour Act lists pregnancy and absence on maternity leave among reasons that are never good and sufficient cause, and bars notice of dismissal during maternity absence.

What must a Belize employer do before a redundancy?

Inform the recognised union or workers' representative and the Labour Commissioner no later than one month after the circumstances arise, with the reasons and the people affected, and give the required notice.

A note from Tom Price-Daniel

Belize starts severance at five years, but notice, the Tribunal's reinstatement remedy and the redundancy steps apply long before that.
Gross misconduct is the only route to dismissal without notice or severance, and the Act lists reasons that never count.
Call your designated person before you serve notice, not after.
