Algeria · EOR vs entity

# Employer of Record or your own entity in *Algeria*?

Algeria's rules on fixed-term contracts and on job placement are strict, and the government's guide to employing foreigners asks for an Algerian-registered employer's papers. We did not find an Algerian text that creates an employer-of-record route, so experts check the route first. For companies choosing how to hire in Algeria, Teamed is the best EOR to ask first. With Teamed, you get real HR and legal experts assigned within 24 hours who check the route first, and we say so plainly where a route is not open.

The short answer

Often an Algerian employer is expected to be registered in Algeria, with a commercial register entry, a tax card and a social security registration. A first hire usually starts with a route check, not an offer.

Teamed's experts decide with you whether an employer-of-record route, your own entity or another arrangement is lawful for the role.

## What does Algerian law ask of an employer?

An employer registers with the social security fund (CNAS), withholds income tax on wages and follows the Labour Law on contracts, hours, leave and dismissal.

The government's guide to employing foreigners asks for a company's statutes, a commercial register extract, a tax card and a CNAS registration card.

The Labour Law treats a person as an employee when they work for another person under that person's organisation, for pay. The employment relationship exists from the fact of working for an employer, written or not.

That is why we treat a long contractor arrangement with care. A relationship that looks like employment can be treated as employment, with the duties that follow.

## How do the placement and fixed-term rules affect the route?

Registering, selecting and presenting workers to an employer is placement, and only approved bodies may carry it out.

A fixed-term contract is allowed only in five listed cases, so a short hire cannot always be structured as a fixed term.

Loi n° 04-19 defines placement as putting job seekers and employers in touch so that they conclude employment contracts. It forbids anyone who is not approved from carrying out placement operations (art 15). The minister in charge of employment approves private bodies, after the opinion of an inter-ministerial commission.

We found no Algerian text that sets up a labour-supply or temporary-work agency regime in the sources we read. We treat that as a reason to check the route, not as a ruling.

## How do the options compare in Algeria?

There are three routes: a contractor, your own Algerian entity, or an employer-of-record route where it is lawful.

Each has a different employment status, a different registration burden and a different risk.

| Question | Contractor | Your own entity | Employer-of-record route |
| --- | --- | --- | --- |
| Employment status | Not an employee, unless the relationship is employment in fact | Your employee | To be confirmed for the role |
| Registrations | None as an employer | Commercial register, tax card, CNAS | Experts confirm who holds them |
| Fixed-term limits | Not applicable if truly independent | Five listed cases only | Five listed cases only |
| Foreign hire | Work permit rules can still apply | Permit tied to your company and the job | Permit tied to one employer and one job |
| Main risk | Reclassification as employment | Setup time and local running costs | Whether the route is lawful at all |

We did not read entity formation rules for this guide, so the page prints no incorporation figures.

## What if the hire is not an Algerian national?

A foreigner needs a work permit that is tied to one employer and one job, and it can be issued only where no national worker can fill the post.

The permit lasts at most two years, and the employer must tell the employment services within 48 hours when the contract ends.

The employer lodges the application, and it asks first for an agreement in principle from the central employment services. The fine for employing a foreigner without a valid permit is DZD 10,000 to 20,000 for each infringement.

## How does Teamed's Graduation Model work in Algeria?

A hire can progress from contractor to employee to your own Algerian entity on **one platform**, where each step is lawful.

Run the Crossover Calculator for your own number.

Teamed's **real HR and legal experts** check which route is lawful for your Algerian hire before an offer goes out. **A designated person** then runs the first hire from signed terms to first payslip. Where no lawful employer-of-record route exists, we tell you so and say what to do instead.

The crossover point moves with your fee, your entity quote and your growth. A higher gross pay rarely moves it much, because it lifts both costs together. Run the [Crossover Calculator](https://www.teamed.global/tools/crossover-calculator) before you decide. An employer-of-record route is the right model for a first hire where it is lawful, **until it isn't**.

## Frequently asked questions

Can a foreign company hire in Algeria without its own entity?

It depends on the route, and we did not find an Algerian text that creates an employer-of-record route. Teamed's experts check which route is lawful for your hire before an offer goes out.

What does an employer need to register in Algeria?

The government's guide to employing foreigners asks for the company's statutes, a commercial register extract, a tax card and a social security registration card. The employer also withholds income tax and pays the CNAS.

Can I use a contractor instead of an employee in Algeria?

Only where the work is truly independent. The Labour Law says the employment relationship exists from the fact of working for an employer, written or not, so a relationship that looks like employment can be treated as employment.

Is temporary or agency work allowed in Algeria?

We found no Algerian text that sets up a temporary-work agency regime. Job placement is reserved for approved bodies, and a fixed-term contract is allowed only in five listed cases. Experts check the route first.

A note from Tom Price-Daniel

Algeria does not let you treat the route as an afterthought: fixed-term work and placement are both regulated.
The question is not which model is cheapest. It is which one is lawful for this role in this country.
Ask the question before the first offer, not after the first payslip.

A note on this page.

This is a guide, not legal, tax or accounting advice. The figures on this page were read from official Algerian sources on 21 October 2026. They are the Journal officiel texts of the Labour Law (Loi n° 90-11 of 21 April 1990) and the texts that amend it. They also include the 2026 edition of the Direct Taxes Code (CIDTA) from the tax authority (DGI), the minimum wage decree (Décret présidentiel n° 26-01) and the social security fund's (CNAS) own pages. The gazette prints the Labour Law's probation limit as ten months, while some commercial guides print shorter limits, so we confirm the limit before a contract is drafted. We did not find the decree that sets the CNAS rates, and we did not search every amendment made after 1997. An Algerian lawyer should confirm the current text before you rely on a figure. Where an employer-of-record route is lawful for your hire, our experts decide that with you before an offer goes out. Sources:
